Policy Framework for Investments – Changes to 3rd Party Template Agreements

Our aim is to continue to make it easier to do business with Network Rail in relation to investments in the network.

We are revising the template agreements following extensive consultation with stakeholders and to meet ORR’s requirements under Part G of the Network Code. The changes that are being made to the template agreements are focused on improving clarity for customers wishing to invest in the network.  In addition we will take this opportunity to improve the agreements through simplification and standardisation of common issues across the different templates.

The agreements update process:

Each template agreement will follow a consistent update process.

The revised draft template and an explanatory note will be added to the relevant section of the Current Consultation section in a staged process.

Network Rail will then welcome comments, within 6 weeks from the date each revised template is issued, from customers and stakeholders on whether or not the changes set out in ORR’s letter (Investment Framework – ORR conclusions on our review of the approach to third party investments, 9th May 2008) have been properly taken account of in the revised template. The last date for consultation responses for each template agreement is set out in the Template Agreement Tracker along with the current status in the consultation process of the template agreements.

Network Rail will take due account of stakeholder comments and subsequently resubmit in a staged process, the template agreements for approval by ORR.
